Happy ang New Year niya: Sandiganbayan throws out graft case vs ex-councilor Holgnaza
Since it took almost 13 years for the Office of the Ombudsman to file the case, the Sandiganbayan Second Division dismissed due to inordinate delay the graft charge against former Cebu City Councilor Rico Rey Holgnaza.
In its resolution, the Second Division ruled that “the Court finds that the accused-movant’s right to speedy disposition of his case was violated.”
The case stemmed from the alleged anomalous construction of a low-cost condominium project in Cebu.
The Ombudsman-Visayas conducted a preliminary investigation on August 2000. Five years later, Ombudsman Simeon Marcelo approved the filing of the case before the Sandiganbayan.
However, it was only in June 24, 2013 that the case was filed before the anti-graft court.
“To Our mind, such very long period of time constitutes excessive delay and a grave violation of the constitutionally ordained right of an accused to speedy disposition of cases,” stated the Sandiganbayan.
